Das Institut für Solarenergieforschung GmbH („ISFH“) bietet interessierten Nutzern über seine Homepage die Anwendung „Daidalos Cloud“ zur Simulation von Solarzellen und Modulen an. Die Nutzung erfolgt auf der Homepage des ISFH und ist unentgeltlich, erfordert aber eine Registrierung des Nutzers sowie dessen ausdrückliche Zustimmung zu diesen Nutzungsbedingungen.

Nutzer können sich bei Fragen oder Interesse gerne an das ISFH wenden. Ein Anspruch auf Beratung und technischen Support kann aber leider nicht gewährt werden. Das ISFH ist bestrebt, „Daidalos Cloud“ fortzuentwickeln, neue Versionen aufzusetzen und diese ggf. auch entgeltlich zur Nutzung anzubieten. In diesem Fall werden die Nutzungsbedingungen neu geregelt und der Nutzer muss einer entgeltlichen Nutzung ausdrücklich zustimmen.

Vor der erstmaligen Anwendung von „Daidalos Cloud“ erfolgt eine Registrierung des Nutzers mit Angabe der Nutzerdaten (Name, E-Mail, Organisation, Adresse) und Festlegung eines Passwortes durch den Nutzer. Jede nachfolgende Nutzung („Sitzung“) bedarf der Eingabe des Nutzernamens und des Passwortes. Der Nutzer ist für einen angemessenen Schutz des Passwortes verantwortlich.

Der Nutzer kann sich jederzeit aus „Daidalos Cloud“ abmelden. Nach erfolgter Abmeldung ist bei erneuter Anmeldung zwingend eine neue Registrierung notwendig.

2.1

„Daidalos Cloud“ ist urheberrechtlich geschützt. Die Eigentumsrechte und Urheberrechte liegen und bleiben vollumfänglich beim ISFH. Ein Entgelt für die Nutzung wird nicht erhoben.

2.2

„Daidalos Cloud“ läuft auf den Servern des ISFH oder auf Servern der vom ISFH beauftragten Dienstleister. Nutzungsrechte an „Daidalos Cloud“ sind daher nicht notwendig und werden auch nicht eingeräumt. Allein etwaige Nutzungsrechte an Programmen, die zur Darstellung von „Daidalos Cloud“ auf dem Endgerät des Nutzers technisch unabdingbar sind, werden hiermit nicht ausschließlich, nicht übertragbar, unentgeltlich und auf die Laufzeit des Vertrages beschränkt, eingeräumt.

2.3

Der Nutzer erklärt sich damit einverstanden, bei der Publikation von Ergebnissen, die unter Nutzung von „Daidalos Cloud“ entstanden sind und von diesem ausgewiesen werden, durch einen geeigneten Hinweis die Urheberschaft des ISFH anzuzeigen, etwa: Die Ergebnisse entstammen der Anwendung „Daidalos Cloud“ des ISFH.

Das ISFH ist berechtigt, „Daidalos Cloud“ jederzeit nach eigenem Ermessen inhaltlich, technisch, in der Art der Darstellung und/oder seinen Funktionalitäten anzupassen.

Das ISFH ist ferner berechtigt, „Daidalos Cloud“ insgesamt einzustellen und/oder gegen eine entgeltliche Version zu ersetzen. Beides ist den Nutzern mit einer Frist von sechs Wochen anzukündigen.

4.1

Trotz gewissenhafter Erstellung und Prüfung von „Daidalos Cloud“ übernimmt das ISFH keine Gewährleistung, insbesondere keine Gewährleistung für

• bestimmte zeitliche, technische und inhaltliche Verfügbarkeiten von „Daidalos Cloud“, und/oder
• die Richtigkeit und/oder Vollständigkeit der ausgewiesenen Ergebnisse sowie
• die Eignung von „Daidalos Cloud“ und/oder der ausgewiesenen Ergebnisse für einen bestimmten Zweck.

4.2

Ein Support findet nicht statt. Ein Anspruch auf Updates besteht nicht.

5.1

Die technischen Voraussetzungen einschließlich der Eingabeformate werden vom ISFH vorgegeben. Das ISFH ist jederzeit berechtigt, die technischen Voraussetzungen dem Stand der Technik und/oder den Sicherheitsanforderungen anzupassen.

5.2

Nutzungs- und Sicherheitshinweise sind vom Nutzer einzuhalten. Er trägt dafür Sorge, dass bei ihm die Hard- und Softwarevoraussetzungen für „Daidalos Cloud“ gegeben sind.

5.3

„Daidalos Cloud“ wird ggf. auch auf externen Servern betrieben. Das ISFH hat dazu mit dem/n Anbieter(n) angemessene und übliche Sicherheitsstandards vereinbart und implementiert. Für den Fall der Verarbeitung personenbezogener Daten (die allenfalls bei der Registrierung erfolgen kann), liegt eine Vereinbarung nach Art. 28 (3) DSGVO vor.

Hiermit erklärt sich der Nutzer einverstanden.

6.1

„Daidalos Cloud“ selbst verarbeitet keine personenbezogenen Daten gemäß Art. 4 (1) DSGVO. Allein bei der Registrierung werden diese erfasst und gespeichert. Dies erfolgt ausschließlich zur Umsetzung dieses Vertrages gemäß Art. Art. 6 (1) lit b. DSGVO. Informationen zum Datenschutz und ihre Rechte finden Sie hier: https://isfh.de/data-protection-policy/.

6.2

Die vom Nutzer eingegebenen technischen Daten werden mit Beendigung der Sitzung automatisch gelöscht, sofern keine Simulation gestartet wurde. Wenn eine Simulation gestartet wurde, werden die vom Nutzer eingegebenen technischen Daten und dazugehörende Simulationsergebnisse gespeichert, aber nach drei Monaten automatisch von „Daidalos-Cloud“ gelöscht.

Hiervon ausgenommenen ist eine Übersicht der Ergebnisse und Eingabeparameter in einem persönlichen Zugangsbereich, den der Nutzer einrichten kann. Hier kann er die Daten jederzeit selbst löschen. Diese Übersicht wird mit Abmeldung durch den Nutzer (§ 1) bzw. der vollständigen Einstellung von „Daidalos Cloud“ nach § 3 - auch im persönlichen Zugangsbereich - abschließend gelöscht.

6.3

Das ISFH wird eingegebene und gespeicherte Daten (Ziffer 6.2) vertraulich behandeln und nicht an Dritte weitergeben. Hiervon ausgenommen ist die Weitergabe an Anbieter externer Server, auf denen „Daidalos Cloud“ ggf. läuft (Ziffer 5.3).

Das ISFH ergreift die erforderlichen und angemessenen Maßnahmen, um eingegebene oder gespeicherte Daten (Ziffer 6.2) vor Verlust/Zerstörung und unberechtigten Zugriff zu schützen. Der Nutzer ist verpflichtet,

• hieran im erforderlichen Umfang mitzuwirken,
• sorgsam mit seinen Daten und seinem Passwort umzugehen und
• selbst regelmäßige Backups eigener Daten zu erstellen.

Eine Haftung des ISFH für unberechtigte Zugriffe von außen (Hackerangriff o.Ä.) ist in den Grenzen des § 8 ausgeschlossen.

Das ISFH ist zur Sperrung einzelner Nutzer berechtigt, wenn diese „Daidalos Cloud“ nicht bestimmungsgemäß nutzen oder die Nutzung die Funktionalität gefährdet. Das ISFH ist ferner zur Sperrung berechtigt, wenn das Passwort mindestens dreimal nacheinander falsch eingegeben wurde oder der Nutzer seinen Zugang für einen Zeitraum von mindestens 12 Monaten nicht genutzt hat.

Die Haftung des ISFH auf Schadensersatz ist außer im Falle von Vorsatz und grober Fahrlässigkeit ausgeschlossen und, außer im Falle des Vorsatzes, auf den vorhersehbaren, typischerweise eintretenden Schaden begrenzt. Hiervon unberührt bleibt die Haftung wegen schuldhafter Verletzung von Leben, Körper und Gesundheit.

Der Vertrag beginnt mit Zustimmung des Nutzers zu diesen Nutzungsbedingungen und wird auf unbestimmte Zeit geschlossen. Er endet

• durch den Nutzer über eine Abmeldung nach § 1,
• durch das ISFH mit einer Nutzersperrung nach § 7,
• durch das ISFH im Falle der vollständigen Einstellung von „Daidalos Cloud“ und/oder dessen Umstellung auf eine entgeltliche Version.

In beiden letztgenannten Fällen hat eine Kündigung durch das ISFH mit einer Frist von sechs Wochen zu erfolgen (Ziffer 3).

10.1

Das ISFH ist berechtigt, diese Nutzungsbedingungen anzupassen. Es wird den Nutzer hierüber vorab mit einer Frist von vier Wochen in Textform (per Mail) informieren und den Nutzer hierbei gesondert darauf hinweisen, dass er der Änderung widersprechen kann. Der Widerspruch in Textform (per Mail) ist ausreichend. Unterbleibt ein Widerspruch innerhalb der genannten Frist, gelten mit Ablauf der vier Wochen allein die angepassten Nutzungsbedingungen.

Ausgenommen hiervon sind Regelungen, die eine entgeltliche Nutzung von „Daidalos Cloud“ begründen. Für diese ist eine ausdrückliche Zustimmung des Nutzers erforderlich. Gesetzliche Vorgaben (etwa Hinweise auf bestehende Widerrufsrechte) sind einzuhalten.

10.2

Ausschließlicher Gerichtsstand ist Hannover.

10.3

Sollte eine Bestimmung dieses Vertrages unwirksam sein oder werden oder der Vertrag eine Lücke enthalten, so bleibt die Rechtswirksamkeit der übrigen Bestimmungen hiervon unberührt. Anstelle der unwirksamen Bestimmung gilt eine wirksame Bestimmung als vereinbart, die der von den Parteien gewollten wirtschaftlich am nächsten kommt; das gleiche gilt im Falle einer Lücke.

10.4

Dieser Vertrag unterliegt dem Recht der Bundesrepublik Deutschland unter Ausschluss des internationalen Privatrechts und des UN-Kaufrechts.

The Institute for Solar Energy Research GmbH ("ISFH") offers via its homepage the application "Daidalos Cloud" for the simulation of solar cells and modules. „Daidalos Cloud“ runs technically on the homepage of the ISFH and is free of charge, but requires a registration of the user and his explicit consent to this Terms of Use.

Users are welcome to contact the ISFH if they have any questions or comments. However, no right to consultation and technical support will be granted. The ISFH intends to develop „Daidalos Cloud“ further, to set up new versions and potentially to offer a paid version. In this case, the terms of use will be redefined totally and any fee has to be approved explicitely by the user.

Prior to the first use of "Daidalos Cloud", the user has to be registered with his user data (name, e-mail, organization, address) and a password set by the user. Each subsequent use ("session") requires the entry of the username and password. The user is responsible for an adequate protection of the password.

The user can at any time deregister himself from "Daidalos Cloud". Any further use after such deregistration would need a complete new registration.

2.1

"Daidalos Cloud" is protected by copyright. The Copyright and any further rights belong to ISFH and shall remain with ISFH. The use of „Daidalos Cloud“ is free of charge.

2.2

"Daidalos Cloud" runs on ISFH‘s server or on server of providers authorized by ISFH. So no right of use to „Daidalos Cloud“ is needed and, therefore, will not be granted. However, any rights of use to programs that are technically essential for the presentation of "Daidalos Cloud" on the user's device are granted not exclusively, not transferable, free of charge and limited to the duration of this contract.

2.3

The user agrees to use an appropriate reference to the authorship and copyright of the ISFH when he publishes results that have been produced by using "Daidalos Cloud", e.g.: The results are from the "Daidalos Cloud" application of the ISFH.

ISFH shall be entitled to adapt "Daidalos Cloud" at any time in its own discretion in terms of content, technology, type of presentation and/or its functionalities.

Further ISFH shall be entitled to terminate "Daidalos Cloud" in general („shut down“) and/or to replace it with a paid version. Both must be announced to the users with a period of six weeks.

4.1

Despite precise and conscientious work on „Daidalos Cloud“ and its testing ISFH does not take over any warranty, in particular no warranty for

• certain temporal and/or technical availability of "Daidalos Cloud" and/or the availabilty with regard to spefic content, and/or
• the accuracy and/or completeness of the reported results, and/or
• the suitability of "Daidalos Cloud" and/or of the results for a particular purpose.

4.2

ISFH does not provide any support. User has no right for updates.

5.1

The technical requirements including the input formats are specified by ISFH. ISFH is entitled at any time to adapt these conditions to the state of the art and/or the safety requirements.

5.2

Usage and safety instructions must be observed by the user. He ensures that hardware and software requirements needed for "Daidalos Cloud" are met.

5.3

"Daidalos Cloud" may be operated from external servers. The ISFH has agreed on and implemented appropriate security standards with the providers (of external servers). Where processing of „personal data“ acc. Art. 4 (1) GDPR will be carried out on behalf of ISFH, an agreement according to Art. 28 (3) GDPR has been settled. The user agrees to that.

6.1

"Daidalos Cloud" itself does not process any personal data acc. Art. 4 (1) GDPR , but such may be needed for the registration procedure. However, this is just done to perform this contract (in accordance with Art. 6 (1) 1 lit b. DSGVO). 6.2

The technical data entered by the user will be automatically deleted when the session ends, unless a simulation has been started. When a simulation is started, these technical data and corresponding simulation results will be stored, but automatically deleted from the Daidalos cloud after three months.

Excluded from this is an overview of the results and input parameters will be stored in a personal access area that the user may set up. In this area he can delete his data himself at any time. This overview will be finally and completely deleted (also in the personal access area) in case of a deregistration (§ 1) or in case of a shut down (§ 3).

6.3

The ISFH will treat entered and/or stored data (§ 6.2) confidentially and will not pass them on to third parties. This shall not apply for the distribution to providers of external server on which "Daidalos Cloud" may run (§ 5.3).

The ISFH will take the necessary and appropriate measures to protect data entered and/or stored (§ 6.2) from loss/destruction and unauthorized access. However, the user is obliged to (i.) contribute to safety proceedings as far as necessary, (ii.) to handle his data and his password with care and (iii.) to backup his data constantly.

Any liability of the ISFH for unauthorized access from outside (hacker attack or similar) shall be excluded within the limits of § 8.

ISFH is entitled to block users if they do not use "Daidalos Cloud" as intended or if their use may harm the functionality of „Daidalos Cloud“. The ISFH shall also be entitled

• to block an user if the password has been entered incorrectly at least three times consecutively, and/or
• to deregister (§ 1) an user if his account has not been used for a period of at least 12 month.

 

The liability of ISFH for damages shall be excluded except in the case of intent and gross negligence and, except in the case of intent, limited to the predictable, typically occurring damage. This does not affect the liability for culpable injury to life, limb and health.

The contract begins with the user's consent to these Terms of Use and is concluded for an indefinite period. It ends

• by ISFH via a user blocking or deregistration according to § 7,
• by the user via a deregistration according to § 1, or
• in case of a shut down of "Daidalos Cloud" and/or its conversion to a paid version according § 3.

In both of these latter cases, a dismissal by the ISFH must take place with a notice period of six weeks (§ 3).

10.1

ISFH is entitled to adapt these Terms of Use. ISFH will inform the user about this in advance with a notice period of four weeks in text form (by e-mail) and will also inform him that he can object to these changes. For such an objection an e-mail is sufficient. If an objection does not occur within the given period, the adapted terms of use apply after the end of the four-week period.

Sentence 1 to 3 shall not apply for changes that constitute a fee for the use of "Daidalos Cloud" In such a case an explicit consent of the user is required. Additional legal requirements (such as references to existing rights of revocation) must be observed.

10.2

Exclusive place of jurisdiction is Hannover.

10.3

Should a provision of this contract be or become ineffective or the contract contain a gap, the legal validity of the remaining provisions shall remain unaffected. In place of the invalid provision, an effective provision shall be deemed to have been agreed, which comes closest to the economic intention of the parties; the same applies in the case of a gap.

10.4

This contract is subject to the laws of the Federal Republic of Germany, excluding international private law and the UN Sales Convention.
